Now it sure would be something if these two stories were actually connected and that the 5th Circuit court of appeals had struck down the infamous Biden vaccine mandate based on known health issues but that's not the real story.
In fact what has happened in the 5th Circuit in New Orleans is due to their consideration that the rule is far too broad. It is essentially a rule that Biden announced as a vaccine mandate but in fact is a weekly testing mandate with a vaccine exemption.
So how can we make it highly inconvenient and very costly for people to not succumb to an experimental shot?
Require workers to get weekly testing at their own expense UNLESS they've been jabbed.
Of course that doesn't mean that OSHA has the authority, nor the personnel to execute on such a rule.
Here's some of how the 5th Circuit responded:
"The mandate is staggeringly overbroad," the opinion said.
"The mandate is a one-size-fits-all sledgehammer that makes hardly any attempt to account for differences in workplaces (and workers)," Circuit Court Judge Kurt Engelhardt wrote for the panel.
Here's some commentary on that by my favorite Attorney Influencers VivaBarnesLaw.Locals.com
There continues to be more push back against this "testing mandate" mostly stemming from the potential lack of authority of OSHA to oversee such a fiasco.
A group of 12 states filed a new lawsuit against the Biden administration regarding the OSHA mandate Monday (11/15/21) in addition to many other states also suing.
As reported in The Hill:
The lawsuit, filed on Monday, argues the vaccine mandate for health care workers, issued by the Centers for Medicare and Medicaid Services, exceeds the agency’s statutory authority and breaches the Social Security Act’s ban on regulations that control the hiring and firing of health care workers.
“The Biden Administration is playing statutory shell games with the courts, straining to justify an unjustifiable and unprecedented attempt to federalize public health policy and diminish the sovereign States’ constitutional powers,” the lawsuit reads.
The plaintiffs are also alleging that the mandate violates the Spending Clause, the Anti-Commandeering Doctrine, the 10th Amendment's protections for states' rights and a number of federal laws.
The attorneys general of Alabama, Arizona, Georgia, Idaho, Indiana, Louisiana, Mississippi, Montana, Oklahoma, South Carolina, Utah and West Virginia are all listed as plaintiffs in the lawsuit.
The Hill also reported last week about a different 10 state lawsuit and from what I've heard it is up to 26 states suing in total but it's hard to keep up with them all!
A coalition of 10 states, led by Missouri, has filed a lawsuit against the Biden administration's COVID-19 vaccine mandate imposed on health care workers, which they said was "unconstitutional and unlawful."
Missouri was joined in the suit by eight other states with GOP governors: Nebraska, Arkansas, Iowa, Wyoming, Alaska, South Dakota, North Dakota, and New Hampshire. Kansas, the 10th state, has a Democratic governor, Laura Kelly, but is a reliably Republican state in presidential elections.
"Unfortunately, with this latest mandate from the Biden Administration, last year’s healthcare heroes are turning into this year’s unemployed," Missouri Attorney General Eric Schmitt said in an official statement.
Schmitt added that requiring health care workers to get a vaccination or face termination is "unconstitutional and unlawful, and could exacerbate healthcare staffing shortages to the point of collapse, especially in Missouri’s rural areas."
He said that his office will continue to challenge what he called the Biden administration's "illegal edicts."
Workplace vaccination mandates are at the center of controversy around the country.
Calling the vaccine mandates an "unprecedented federal overreach,” Schmitt said they jeopardize the healthcare interests of rural Americans.
Clearly on the legal front there are major issues with this OSHA testing mandate for businesses with more than 100 employees but isn't the pushback in public opinion really being driven by all the reports of injury from these shots that are getting harder and harder for the media to hide under the rug?
After all when you see reports like this flooding the airwaves it makes even the average person wonder...
And sure, there is no way to directly connect all these deaths and injuries in healthy young athletes to the shots (except by autopsy) but knowing what we've covered here on KnowingTheTruth.com over the last year or so since these shots have been released and all the pathology information the potential for vascular damage is huge and these effects should be expected.
So it's not all that surprising that there is a US Workers Rebellion swelling over this gross overreach of power. As reported in Reuters:
"We're going to lose a lot of employees over this," said Cornell Beard, head of the local Machinists union district. Many workers did not object to the vaccines as such, he said, but were staunchly opposed to what they see as government meddling in personal health decisions.
The union district has hired a Texas-based lawyer to assist employees and prepare potential lawsuits against the companies should requests for medical or religious exemptions to vaccination be denied.
A life-long Democrat, Beard said he would no longer vote for the party. "They'll never get another vote from me and I'm telling the workers here the same thing."
This was also reported on The Highwire with Del Bigtree and Jefferey Jaxen:
Considering what continues to come out about these experimental jabs all this pushback is not too surprising...
Here's a new Physical Therapist "whistleblower" and I only put that in quotes because she is still anonymous at this point. Hopefully more of these people will be able to discuss this more openly. I believe that you can hear the authenticity in her voice:
